Terms of Service

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

You agree to provide accurate, current, and complete information when creating your account and to keep your information up to date.

You retain ownership of any content you submit to the Service, including your profile information, resume, and messages ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display your User Content solely for the purpose of operating and improving the Service.

You represent and warrant that your User Content does not infringe any third-party intellectual property rights and does not violate any applicable laws.

We reserve the right to remove any User Content that violates these Terms or that we find objectionable, at our sole discretion.

Certain features of the Service are available only through paid subscription plans ("Plans"). By subscribing to a Plan, you agree to pay the applicable fees as described on our pricing page.

All payments are processed securely by Stripe. We do not store your payment card details. Fees are billed in advance on a monthly or annual basis, depending on your selected Plan.

Subscriptions automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial periods except where required by applicable law.

We reserve the right to change our pricing with reasonable notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

The Service and its original content, features, and functionality (excluding User Content) are owned by Bergwind合同会社 and are protected by applicable intellectual property laws. You may not reproduce, modify, distribute, or create derivative works based on the Service without our prior written consent.

"Atarashift" and associated logos are trademarks of Bergwind合同会社. Nothing in these Terms grants you any right to use our trademarks without our prior written permission.

The Service integrates with third-party services including Supabase, Stripe, and Vercel. Your use of such third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party services.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee the accuracy, completeness, or usefulness of any content on the Service, including job listings and company profiles. We are not responsible for the outcome of any employment relationship formed through the Service.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BERGWIND合同会社 SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM, OR ¥10,000, WHICHEVER IS GREATER.

You agree to indemnify and hold harmless Bergwind合同会社 and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of or relating to your use of the Service, your User Content, or your violation of these Terms.

We reserve the right to suspend or terminate your account at any time, with or without notice, if you violate these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by contacting us or using the account deletion feature in your settings.

These Terms are governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Tokyo, Japan.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
